- What you agree to: By using Bella Booking, you agree to use it lawfully and not for spam, fraud, or harmful purposes.
- Subscription billing: Plans are billed monthly in advance and auto-renew. Free trials convert to paid plans unless you cancel first.
- Cancellation: You can cancel any time from your Settings dashboard. Your data is deleted within 90 days of cancellation.
- Support access: Our team may log in to your account to help with support. Access is logged, limited, and confidential.
- Liability cap: Our total liability is capped at what you paid us in the last 12 months.
- Price changes: We give at least 30 days' notice before any pricing changes.
- Governing law: These terms are governed by the laws of New South Wales, Australia.
- Australian Consumer Law: Nothing in these terms limits your rights under the Australian Consumer Law, including guarantees for services.
By using this website you agree to be bound by the terms and conditions set out on this webpage. If you do not accept these terms and conditions, you must refrain from using this website. AUSTRALIAN CONSUMER LAW
Our services are provided to Australian customers in compliance with the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010). Nothing in these terms and conditions excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law or any other applicable Australian law that cannot be excluded, restricted, or modified by agreement.
If our services fail to comply with a consumer guarantee under the Australian Consumer Law, you are entitled to a remedy in accordance with that law. For major failures with a service, you are entitled to cancel your service contract with us and obtain a refund for the unused portion, or to compensation for the reduced value of the services provided. For minor failures, you are entitled to have the issue rectified in a reasonable time.
INTELLECTUAL PROPERTY
Unless otherwise indicated, all materials used on this website (including text, graphics, logos, icons, sound recordings and software) are subject to copyright, trade mark or other intellectual property rights that are owned or licensed by us. You may only access and use these materials for non-commercial or personal use, except to the extent permitted by law or where you have received prior written approval from us

Our website may contain links to websites operated by third parties. Those links are provided for convenience and may not remain current or be maintained. Unless expressly stated otherwise, we do not endorse and are not responsible for the content on those linked websites and have no control over or rights in those linked websites.
ACCEPTABLE USE
Your use of the Website and Service must not violate any applicable laws, including copyright or trademark laws, export control or sanctions laws, or other laws in your jurisdiction. You are responsible for making sure that your use of the Service is in compliance with laws and any applicable regulations.
Prohibited Actions
Customers may not use a service to, nor allow its users or any third party to use a service to:
- Generate or facilitate unsolicited commercial email (spam). Such prohibited activity includes, but is not limited to:
- Sending communications or email in violation of the CAN-SPAM Act, the Australian Spam Act 2003, or any other applicable anti-spam law or regulation;
- Imitating or impersonating Bella Booking, another person or his, her, or its email address, or creating false accounts for the purpose of sending spam;
- Mining data or harvesting any web property (including any External-Facing Service) to find email addresses or other user account information;
- Sending unauthorized mail via open, third-party servers;
- Sending email to users who have requested to be removed from a mailing list;
- Selling to, exchanging with, sharing with, or distributing to a third party personal information, including the email addresses of any person without such person's knowing and continued consent to such disclosure; or
- Sending unsolicited emails to significant numbers of email addresses belonging to individuals and/or entities with whom you have no preexisting relationship;
- Create, send, upload, display, store, process, or transmit unlawful, defamatory, harassing, abusive, fraudulent, infringing, obscene, excessively profane, hateful, violent, or otherwise objectionable material nor use the services to send, display, or transmit sexually explicit material;
- Create, send, upload, display, store, process, or transmit highly deceptive manipulated or synthetic digital media that is fabricated or false but presented as authentic or fact based and intended to deliberately sway audiences towards a specific interest or agenda, including, but not limited to, deepfakes;
- Promote, support, or facilitate unlawful, hateful, discriminatory, or violent causes, including terrorism or violent extremism;
- Intentionally distribute viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any other items of a destructive or deceptive nature;
- Conduct or forward multi-level marketing, such as pyramid schemes and the like;
- Generate or facilitate calls, SMS, MMS, other text messages push notifications, or other uninvited communications in violation of the Telephone Consumer Protection Act, the Do-Not-Call Implementation Act, the Australian Do Not Call Register Act 2006, the Australian Spam Act 2003, or any other applicable law including anti-spam, telemarketing, robocalling, caller ID spoofing, or telephone consumer protection laws or regulations;
- Use the services in any manner that violates any applicable industry standards, third-party policies, or requirements that Bella Booking may communicate to its users, including all of the applicable guidelines published by the CTIA, the Mobile Marketing Association, the Self-Regulatory Principles as directed by the Digital Advertising Alliance and the Network Advertising Initiative, or any other generally accepted industry associations, carrier guidelines, or other industry standards;
- Create, send, upload, display, store, process, or transmit material or otherwise use the Services in a way that may be harmful to minors including, but not limited to, for any purposes related to child exploitation or abuse, such as real or artificial Child Sexual Abuse Material (CSAM);
- Illegally send, upload, display, store, process, or transmit another's intellectual property or other proprietary information without such owner's or licensor's permission;
- Impersonate another person, entity, or Bella Booking (via the use of an email address or otherwise) or otherwise misrepresent themselves or the source of any communication;
- Facilitate or engage in coordinated inauthentic behavior for the purposes of manipulating public debate;
- Violate the rights (such as rights of privacy or publicity) of others;
- Promote, facilitate, or encourage illegal activity;
- Intentionally or unintentionally interfere with the availability of the service for other users, including, but not limited to, engaging in usage practices prohibited by the Documentation;
- Mislead people about voting processes or census processes;
- Engage in activity in connection with illegal peer-to-peer file sharing;
- Engage in or promote gambling, or run a gambling operation;
- "Mine" bitcoins and other cryptocurrencies;
- Sell, distribute, or export illegal or prescription drugs or other controlled substances or paraphernalia;
- Operate an "open proxy" or any other form of Internet proxy service that is capable of forwarding requests to any end user or third-party-supplied Internet host;
- Perform significant load or security testing without first obtaining Bella Booking's written consent;
- Remove any copyright, trademark, or other proprietary rights notices contained in or on the service or reformat or frame any portion of the web pages that are part of the service's administration display;
- Access a third-party web property for the purposes of web scraping, web crawling, web monitoring, or other similar activity through a web client that does not take commercially reasonable efforts to identify itself via a unique User Agent string describing the purpose of the web client and obey the robots exclusion standard (also known as the robots.txt standard), including the crawl-delay directive;
- Use a service in any manner that would disparage Bella Booking;
- Directly manage, as the primary operator, private, for-profit prison facilities or detention centres;
- Engage in activity where the use or failure of a service may result in the death or serious bodily harm of a person, or in significant damage to property.
Content Restrictions
Customers may not, and may not allow any third party, including its users, to use services to create, send, upload, display, store, process, or transmit, or permit use of services to create, send, upload, display, store, process, or transmit:
- Images or likenesses of individuals who have not granted you permission to use such content;
- Adult or Sexually Explicit Content. Examples include sexual merchandise, pornography, sexual services, and items displaying nudity or implied sexual acts;
- Material that infringes or misappropriates a third party's intellectual property or proprietary rights;
- Hate-related material, and/or material advocating discrimination against individuals or groups;
- Material advocating or advancing violent causes, including terrorism or violent extremism;
- Obscene, excessively profane material or otherwise objectionable material;
- Material advocating or advancing criminal hacking, cracking, or phishing;
- Material related to illegal drugs or paraphernalia;
- Malicious material;
- Unlawful software;
- Malicious code, such as viruses, worms, time bombs, Trojan horses, and other harmful or malicious files, scripts, agents, or programs; or
- Material that violates, encourages, or furthers conduct that would violate any applicable laws, including any criminal laws, or any third-party rights, including publicity or privacy rights.
CANCELLATION AND TERMINATION
Account Cancellation
It is your responsibility to properly cancel your account with Bella Booking. You can cancel your account at any time by going into your Settings in the dashboard. The Settings screen provides a simple, no questions asked cancellation link. We are not able to cancel accounts in response to an email or phone request.
Upon Cancellation
We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements, but barring legal requirements, we will delete your full profile and the Content of your account within 90 days of cancellation or termination (though some information may remain in encrypted backups). This information cannot be recovered once your account is cancelled.
Upon request, we will make a reasonable effort to provide an account owner with a copy of your lawful, non-infringing account contents after account cancellation or termination. You must make this request within 90 days of cancellation or termination.
Bella Booking May Terminate
Bella Booking has the right to suspend or terminate your access to all or any part of the Website at any time, with or without cause, with or without notice, effective immediately. Bella Booking reserves the right to refuse service to anyone for any reason at any time.
DISCLAIMER OF WARRANTIES
To the maximum extent permitted by applicable law, Bella Booking provides the Website and the Service "as is" and "as available," without warranty of any kind. Without limiting this, we expressly disclaim all warranties, whether express, implied, or statutory, regarding the Website and the Service, including without limitation any warranty of merchantability, fitness for a particular purpose, title, security, accuracy, and non-infringement. Nothing in this section is intended to limit or exclude guarantees, warranties, representations, or conditions implied or imposed by law (including the Australian Consumer Law) that cannot lawfully be excluded or limited.
Bella Booking does not warrant that the Service will meet your requirements; that the Service will be uninterrupted, timely, secure, or error-free; that the information provided through the Service is accurate, reliable, or correct; that any defects or errors will be corrected; that the Service will be available at any particular time or location; or that the Service is free of viruses or other harmful components. You assume full responsibility and risk of loss resulting from your downloading and/or use of files, information, content, or other material obtained from the Service.
LIMITATION OF LIABILITY
You understand and agree that we will not be liable to you or any third party for any loss of profits, use, goodwill, or data, or for any incidental, indirect, special, consequential, or exemplary damages, however arising, that result from:
- The use, disclosure, or display of your User-Generated Content
- Your use or inability to use the Service
- Any modification, price change, suspension, or discontinuance of the Service
- The Service generally or the software or systems that make the Service available
- Unauthorized access to or alterations of your transmissions or data
- Statements or conduct of any third party on the Service
- Any other user interactions that you input or receive through your use of the Service
- Any other matter relating to the Service
To the maximum extent permitted by applicable law, our aggregate liability to you for all claims arising out of or relating to the use of or inability to use the Service shall not exceed the amount you have paid to Bella Booking for the Service during the twelve (12) months immediately preceding the event giving rise to the claim. Our liability is limited whether or not we have been informed of the possibility of such damages, and even if a remedy set forth in this Agreement is found to have failed of its essential purpose. We will have no liability for any failure or delay due to matters beyond our reasonable control. Nothing in this section is intended to exclude or limit liability that cannot be excluded or limited under applicable law, including the Australian Consumer Law.
SUBSCRIPTION AND BILLING
Bella Booking offers subscription-based plans billed on a monthly basis. All fees are charged in advance at the beginning of each billing cycle. Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
We may offer a free trial period. At the end of the free trial, your account will be converted to a paid subscription unless you cancel before the trial expires. You will not be charged during the trial period.
Bella Booking reserves the right to change its pricing. We will provide you with at least 30 days' notice of any price changes. If you do not agree to the new pricing, you may cancel your subscription before the new pricing takes effect.
Refunds are generally not provided for partial billing periods. However, this does not limit your rights under the Australian Consumer Law, including your right to a remedy if we fail to meet a consumer guarantee.
ACCOUNT ACCESS FOR SUPPORT
By using the Service, you acknowledge and agree that authorised Bella Booking support personnel may access your account when reasonably necessary to:
- Respond to your support requests or troubleshoot issues you have reported;
- Investigate and resolve technical problems, bugs, or service disruptions;
- Perform maintenance, updates, or migrations necessary for the continued operation of the Service;
- Ensure compliance with these Terms and Conditions and applicable laws.
Such access will be limited to what is reasonably necessary to resolve the issue. We maintain access logs and our personnel are bound by confidentiality obligations. We will not modify your data without your knowledge unless required to resolve a critical issue affecting the availability or integrity of the Service, in which case we will notify you as soon as practicable.
UPDATES
We may change these terms and conditions at any time by updating this webpage and your continued use of the website following such update will represent an agreement by you to be bound by the terms and conditions as amended.
PRIVACY
These terms and conditions also include our Privacy Policy that can be accessed by clicking the link on this page.
JURISDICTION
Your use of the website and these terms and conditions are governed by the laws of NSW, Australia.
Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia. As an Australian-operated business, we are subject to the regulatory oversight of the Australian Competition and Consumer Commission (ACCC) and the Office of the Australian Information Commissioner (OAIC).
INDEMNIFICATION
You agree to indemnify and hold harmless Bella Booking, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.
FORCE MAJEURE
Neither party shall be liable for any failure or delay in performing their obligations under these Terms where such failure or delay results from circumstances beyond the reasonable control of that party, including but not limited to natural disasters, acts of government, internet or telecommunications failures, power outages, pandemics, or cyberattacks.
SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.
ENTIRE AGREEMENT
These Terms and Conditions, together with the Privacy Policy, constitute the entire agreement between you and Bella Booking regarding your use of the Service and supersede all prior agreements, representations, and understandings. No waiver of any term shall be deemed a further or continuing waiver of such term or any other term.
